By accessing or using Beyond Lead ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

The Service is operated by Beyondvision Innovations LLP, a Limited Liability Partnership registered in India ("we", "us", "our", or "the Company"). These Terms apply to all users, including visitors, registered users, team members, and organisation administrators.

If you are using the Service on behalf of a company or organisation, you represent and warrant that you have the authority to bind that entity to these Terms.

Beyond Lead, a product of Beyondvision Innovations LLP, provides an AI-powered business card scanning and sales CRM platform that allows users to capture contacts, manage sales pipelines, generate AI follow-ups, access a public API, configure webhooks, and integrate with third-party tools including HubSpot, WhatsApp Business, Meta Lead Ads, and Zoho CRM.

The Service is provided "as is" and Beyondvision Innovations LLP reserves the right to modify, suspend, or discontinue features at any time with reasonable prior notice where practicable.

You must create an account to use most features. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Not share your account with unauthorised persons
• Notify us immediately of any unauthorised account access at security@beyondlead.space

You are responsible for all activity that occurs under your account, including any API key usage.

You agree not to:

• Use the Service for any illegal purpose or in violation of applicable laws
• Scan or upload business cards without the consent of the individuals whose data is captured
• Attempt to reverse engineer, hack, or gain unauthorised access to any part of the Service
• Send unsolicited marketing messages using contact data captured through the Service
• Resell or commercialise access to the Service without written permission from Beyondvision Innovations LLP
• Use automated bots or scrapers to access the Service beyond what is expressly permitted by the Public API
• Upload malicious files, malware, or content that could harm other users or our systems
• Abuse the Public API in ways that excessively burden our infrastructure
• Use webhook functionality to exfiltrate data in violation of applicable privacy laws

Beyondvision Innovations LLP provides a Public API that allows you to programmatically access your Beyond Lead data. By using the API:

• You are responsible for keeping your API keys secure — treat them like passwords
• You must not share API keys publicly (e.g., in public repositories or client-side code)
• You agree to respect rate limits and usage quotas as published in our API documentation
• You may only use the API to access data belonging to your own organisation
• We reserve the right to revoke API access if we detect abuse, excessive usage, or policy violations
• We may update the API and provide reasonable notice of breaking changes

The Public API is provided for legitimate integration and automation purposes. Scraping or bulk-exporting data for competitive analysis is not permitted.

When you configure webhooks, you are responsible for:

• Securing your webhook endpoints (HTTPS required)
• Validating webhook signatures to prevent spoofed events
• Handling personal data received via webhooks in compliance with applicable privacy laws
• Ensuring webhook endpoints are available and respond within our timeout windows

Beyondvision Innovations LLP is not liable for data breaches arising from insecure webhook configurations on your end.

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all contact data, business card images, and other content you upload. You grant Beyondvision Innovations LLP a limited, non-exclusive licence to process this data solely to provide the Service.

You are responsible for ensuring you have the legal right to collect and process the personal data of contacts you add to the Service, in compliance with applicable data protection laws (including the Indian IT Act 2000, DPDP Act 2023, GDPR, CCPA, and PDPA where applicable).

The Service allows you to connect third-party platforms (HubSpot, WhatsApp Business, Meta, Zoho CRM, Google Sheets). Your use of these integrations is also subject to the respective third-party terms of service. Beyondvision Innovations LLP is not responsible for the actions, availability, pricing, or data practices of third-party services.

The Beyond Lead name, logo, software, and all related materials are the intellectual property of Beyondvision Innovations LLP. You may not copy, modify, distribute, sublicense, or create derivative works based on our intellectual property without express written permission.

You retain all rights to your own content (contacts, notes, uploads). By using the Service, you grant Beyondvision Innovations LLP the limited rights necessary to provide, maintain, and improve the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

BEYONDVISION INNOVATIONS LLP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-EXTRACTED CONTACT DATA WILL BE 100% ACCURATE. YOU SHOULD ALWAYS VERIFY EXTRACTED INFORMATION BEFORE RELYING ON IT FOR BUSINESS DECISIONS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEYONDVISION INNOVATIONS LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) INR 5,000.

You agree to indemnify, defend, and hold harmless Beyondvision Innovations LLP, its partners, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) your use of the Public API or webhooks in an unauthorised manner.

Beyondvision Innovations LLP may suspend or terminate your access to the Service at any time if you violate these Terms, if we discontinue the Service, or for any other legitimate business reason with reasonable notice.

You may terminate your account at any time by deleting it from Settings. Upon termination, your right to use the Service ceases immediately, and any active API keys will be revoked. We will handle your data in accordance with our Privacy Policy.

Beyondvision Innovations LLP may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Mumbai, Maharashtra, India, under the Arbitration and Conciliation Act, 1996.

For matters not subject to arbitration, you consent to the exclusive jurisdiction of the courts of Mumbai, Maharashtra, India.
